1. Agreement to Terms

Welcome to FRYP Fundraising. This Terms of Service agreement (“Terms”) is a legally binding contract between you, whether individually or on behalf of an organization, school, or other entity (“you”), and FRYP Fundraising (“FRYP,” “we,” “us,” or “our”), a company based in the United States. These Terms govern your access to and use of all digital properties and services provided by FRYP, including our website, mobile application, digital fundraising tools, and any future products or services (collectively referred to as the “Services”). By accessing or using any portion of our Services, including browsing the site, creating an account, participating in a fundraiser, or making a purchase or donation, you agree to be bound by the terms and conditions laid out in this agreement. If you do not agree with all of these Terms, you may not use or access FRYP in any form, and should exit the platform immediately.

2. Eligibility to Use FRYP

FRYP’s Services are intended to be used by individuals located within the United States. To use FRYP, you must be at least thirteen (13) years of age. If you are under eighteen (18) years old, you may only use FRYP under the supervision and with the consent of a parent, legal guardian, or an authorized adult affiliated with your school or organization. By using the platform, you confirm that you meet these age and eligibility requirements and that all information you provide is truthful and accurate. Any organization—including but not limited to schools, sports teams, nonprofit groups, or clubs—must designate an adult representative to manage their campaign. This individual is fully responsible for the organization’s activity on the platform.

3. Fundraising Campaigns

FRYP enables organizations and individuals to create and manage fundraising campaigns by offering supporters products to purchase or the option to donate funds directly. When you launch or participate in a campaign using our platform, you are agreeing to accurately represent the identity, affiliation, and purpose of your campaign. This includes presenting truthful information about your organization, the goals of the fundraiser, and how funds will be used. It is your responsibility to fulfill any obligations, rewards, or acknowledgments promised to supporters. FRYP retains the right to review and monitor all fundraising campaigns and may suspend or remove campaigns that contain misleading content, violate any applicable law, promote hate or harm, or otherwise conflict with our mission or standards.

4. Orders and Payments

Supporters who engage with campaigns by purchasing items or making donations will complete their transactions through secure, third-party payment processors. FRYP does not store sensitive payment details such as credit card numbers. Once a transaction is completed, the order is added to our processing system and begins the fulfillment process. While FRYP works to deliver products as efficiently as possible, it is important to understand that deliveries are fulfilled in the order they are processed and may take up to twenty-one (21) days from the time of purchase. This time frame aligns with the full duration of a typical fundraising campaign. Customers should expect their items to be delivered within that 21-day window. In cases of incorrect, damaged, or missing products, supporters must contact FRYP customer support within seven (7) to fourteen (14) days from the date of delivery to request a replacement or refund. FRYP is not liable for delivery delays caused by third-party carriers or other factors outside our control.

5. User Accounts and Responsibilities

Some features of the FRYP platform may require users to create a personalized account. If you choose to register for an account, you agree to provide accurate, current, and complete information during the registration process. You also agree to keep your login credentials secure and not to share your account information with others. You are fully responsible for all activity that occurs under your account, whether or not you authorized it. Creating an account using false information or impersonating another person or organization is strictly prohibited. FRYP reserves the right to disable or terminate any account that violates these Terms, disrupts the platform, or threatens user safety.

6. Prohibited Uses and Behavior

By using FRYP, you agree to engage with the platform in a lawful, respectful, and ethical manner. You may not use the Services to engage in illegal activity, harass others, spread misinformation, infringe on intellectual property, violate privacy rights, or damage the integrity of the platform in any way. This includes attempting to hack or disrupt the system, spamming users, scraping data, impersonating another individual or entity, or using the platform to support harmful causes. FRYP may investigate any suspected violations and take appropriate action, including suspending accounts or removing campaigns that violate our standards.

7. Intellectual Property Rights

All materials and content provided through FRYP—including our logo, product names, website design, written content, images, videos, software, and user interface—are the exclusive property of FRYP Fundraising or its licensors. These elements are protected under U.S. and international intellectual property laws. Users are not permitted to copy, modify, distribute, display, or reuse any portion of the platform for commercial purposes without our explicit written consent. FRYP grants you a limited, non-exclusive license to access and use the platform solely for your own fundraising or support purposes, in accordance with these Terms.

8. Termination of Access

FRYP reserves the right to suspend, terminate, or restrict access to its Services at any time, with or without prior notice, for violations of these Terms or for any conduct that we believe is harmful to our users, platform, or brand. This includes misuse of the Services, fraudulent activity, or behavior that disrupts fundraising operations. Likewise, you may discontinue use of FRYP at any time. Termination of access does not absolve you of any obligations incurred prior to that date, including outstanding payments or contractual responsibilities.

9. Disclaimers

FRYP provides its Services “as is” and “as available,” and disclaims all warranties, express or implied. We do not guarantee that the platform will always be functional, free of bugs, or available without interruptions. Nor do we make any promises regarding the outcome of fundraising campaigns, the success of product sales, or the satisfaction of supporter expectations. Use of the Services is at your own risk, and while we strive to provide a reliable experience, we cannot and do not guarantee perfection in every interaction or transaction.

10. Limitation of Liability

To the fullest extent permitted by applicable law, FRYP and its affiliates, officers, employees, and partners shall not be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services. This includes, but is not limited to, damages resulting from lost revenue, missed fundraising goals, delayed deliveries, data loss, or dissatisfaction with campaign performance. In any event, the total liability of FRYP for any claim related to these Terms or your use of the platform shall not exceed the amount you paid, if any, during the twelve (12) months preceding the claim.

11. Modifications to These Terms

FRYP may revise or update these Terms at any time, and we reserve the sole right to do so. When changes are made, we will update the effective date at the top of this page and may provide notice via email or the platform itself. By continuing to use FRYP after such changes, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically and remain informed about any changes.

12. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Louisiana, United States of America. Any disputes, legal proceedings, or claims arising from or related to your use of the FRYP platform shall be handled exclusively in courts located within the State of Louisiana, and you hereby consent to the jurisdiction of such courts.

13. Geographic Restrictions

FRYP is a United States-based platform and currently only operates within U.S. boundaries. Our fundraising services, product sales, and fulfillment processes are not intended to serve international users or campaigns. We do not support transactions, deliveries, or organizational use outside of the United States. If you access the platform from a location outside the U.S., you do so at your own initiative and assume full responsibility for compliance with any applicable local laws.
